Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FoxScan mobile application, website, and related services (together, the “Service”). Please read them carefully. By using the Service, you agree to these Terms.

1. Acceptance of Terms

By downloading, accessing, or using FoxScan, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service. If you are using the Service on behalf of someone else, you represent that you are authorized to accept these Terms for them.

2. The Service

FoxScan is an informational tool that uses artificial intelligence to help you understand food products. When you scan or upload an image of a product label, the Service attempts to identify ingredients and generate insights such as a health score, allergen flags, ingredient and additive notes, and suggestions for healthier alternatives, and it saves your scans to a history you can review.

The Service depends on the quality of the image you provide, the information printed on the product, and the AI models we use. Results are provided for general informational purposes only, may be incomplete or inaccurate, and should always be verified against the actual product packaging. We may add, change, or remove features at any time.

3. Your Account

Some features require an account. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity that occurs under your account. Notify us promptly at support@foxscan.app if you believe your account has been compromised. You must be old enough to form a binding contract in your jurisdiction to create an account.

4. Subscriptions & Billing

FoxScan offers a free tier with a limited number of scans and a paid “Premium” subscription that unlocks unlimited scanning. Premium is offered as an auto-renewing subscription billed through the Apple App Store or Google Play, depending on your device.

  • Payment is charged to your App Store or Google Play account at confirmation of purchase.
  • Your subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription in your device's account settings. Removing the app does not cancel your subscription.
  • Refunds are handled by Apple or Google under their respective policies; we generally cannot issue refunds directly.
  • Prices may vary by region and may change; we will communicate changes as required by the applicable app store.

5. Not Medical or Dietary Advice

FoxScan is not a medical device and does not provide medical, nutritional, or dietary advice. The health scores, allergen flags, and other insights are informational only and are not a substitute for professional medical or dietary advice, diagnosis, or treatment. Never disregard professional advice or delay seeking it because of something you read in the Service. If you have a food allergy, medical condition, or specific dietary needs, always confirm ingredient and allergen information on the product packaging and consult a qualified professional. Do not rely on FoxScan in situations where an inaccurate result could endanger your health.

6. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its systems;
  • upload content that infringes others' rights or that you do not have the right to submit;
  • use automated means to access the Service in a way that harms or interferes with it; or
  • resell, sublicense, or commercially exploit the Service.

7. Intellectual Property

The Service, including its software, design, logos, and content (excluding your own content), is owned by FoxScan or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain rights to the images you submit; by submitting them, you grant us the license described in our Privacy Policy to process them and provide the Service.

8. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

9. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate or complete.

To the maximum extent permitted by law, FoxScan and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
